Puppy Mills

Puppy Mills
1.What are the animal welfare groups in Singapore doing about Puppy Mills?
The animal welfare groups in Singapore stand strongly against Puppy Mills on all possible levels. This includes raising the issue to the relevant authorities and pushing for legislation changes for better standards, as well as promoting public awareness and education. In a meeting with officials from the Agri-Food & Veterinary Authority (AVA) in the middle of 2010, representatives from key animal welfare groups presented a detailed proposal of recommendations on the issue. Click here for more info.The SPCA also has received complaints regarding puppy mills from concerned individuals. The more common feedback include overcrowding (up to six puppies were cramped in cages), poor ventilation and dirty living conditions. The cases were referred to AVA to investigate with a plea to take strong deterrent action, or revoke the puppy mill’s farm license.
Most puppy mills in Singapore are not illegal, thus while local welfare groups disapprove of puppy mills, it is not within their capability to shut them down or raid them. The public’s strong support is also needed to end consumer demand for puppy mill puppies. You can do your part to end this inhumane industry by adopting your next pet from an animal shelter or rescue group, spreading the word as well as supporting efforts to improve puppy mill conditions.

2.Are there any laws in Singapore that regulate Puppy Mills?
Since January 2009, all pet farms in Singapore are to comply with additional farm licensing conditions introduced by the AVA for dog breeding and sale of puppies. The regulation covers areas such as the living and general health conditions of breeding animals in pet farms. AVA conducts periodic checks on these farms to ensure compliance with the regulation. Anyone who breaches AVA’s licensing conditions faces a fine of up to $5,000, and recalcitrant offenders may be charged in court.

3.How can I find out if pet shops are selling puppies from puppy mills?
Most pet shops are profit driven and thus their supplies of puppies are from puppy mills where dogs are mass bred and sold at low cost.  You may request to be shown the paperwork identifying the puppy’s breeder and the exact location the puppy is from. If the pet shop refuses or is reluctant to do so, you may wish to look for a puppy elsewhere as the origin of the puppy is unknown.
Do remember that responsible breeders generally will not sell their dogs through a pet shop or in any other ways that do not allow an interview or meeting with you. Responsible breeders would want to ensure that the puppy is a good match for your family and that you will provide a responsible lifelong home. Check out these tips on purchasing a puppy.

4.Under what conditions can I report a puppy mill?
If you witness poor conditions, cruelty or neglect (e.g. unsanitary conditions, sick or injured animals not medically treated, inhumane treatment of animals, lack of food/water/shelter, etc.), you may report to the SPCA by dialing 6287 5355 or call the AVA at 6471 9996. We need you to be the voices for the animals.Only when more people speak up can standards improve.

5.I bought a puppy and she is sick, what can I do?
Consult a veterinarian immediately. Any delay in treatment could cost the puppy its life. Symptoms to look out for : inactive, no appetite, diarrhoea, vomiting. (It is advisable to take your puppy for a general physical check up – even if it looks healthy – within a day or two of purchase). A list of clinics can be found here.You should report any illness/death  to the Agri-Food & Veterinary Authority (AVA) which regulates commercial breeding facilities.

6.How about cats and rabbits? Are there such mills that breed them as well?While the number of these facilities is relatively low compared to that of puppy mills’, they do exist. Cats and rabbits in these breeding farms suffer a similar fate as the dogs in puppy mills. If you would like to know more, you can contact the CWS and HRSS.

Setting Up a Non-Profit Entity in Singapore – Part 1

Setting Up a Non-Profit Entity in Singapore – Part 1
A non-profit organization (NPO) in Singapore is a legally constituted organization whose main purpose is to support or engage in activities of public or private interest without any commercial or monetary profit. When NPOs earn a “profit”, more accurately called a surplus, it is retained by the organisation for its future activities and unlike a profit making organisation, does not distribute its earnings amongst its members. NPOs are commonly referred to as Voluntary Welfare Organisations (VWOs) in Singapore and can be registered under the law as a public company limited by guarantee, society, or charitable trust.
Note: This guide provides an overview of registering a non-profit entity in Singapore. For guidance on business structures for starting a for-profit company in Singapore, refer to private limited company registration guide.
KEY CHARACTERISTICS
Non-profit organisations in Singapore:
  • are self-governed by a board of trustees or ‘managing committee’/ governing council, comprising individuals who generally serve in a fiduciary capacity;
  • exist independently of the government;
  • produce benefits for others, generally outside the membership of the organisation; and
  • are ‘non-profit-making’ i.e. they are prohibited from distributing a monetary residual to their own members.
  • are eligible for full tax exemption only after receiving the charity status
REGISTRATION BENEFITS
Although in Singapore it’s not mandatory to register your NPO, it will be difficult to engage in any meaningful and sustainable activities unless you are a registered entity. For example:
  • It is important for you to consider that only legal entities can enter into contractual agreements (e.g. leases, purchasing contracts). If an organisation is not a registered entity, the individual persons concerned may have to accept contractual obligations/liabilities in their personal capacities.
  • Without a registered entity, it will be almost impossible for you to raise funds from non-members.
  • Without a registered entity, you won’t be able to claim tax exemptions on the funds raised.
  • Registering your NPO brings about a sense of clarity and formality. Working with an established set of legally binding rules provides clarity, to those within the organisation and to stakeholders outside the organisation.
  • A registered entity is a criteria which most donors use to evaluate requests for funds. An organisation is publicly accountable once it is registered and this establishes a sense of trust.
TYPES OF ENTITIES
You can choose one of the following three types for registration of your non-profit organization in Singapore:
  • Public company limited by guarantee
  • Society
  • Charitable Trust
The choice of registration route for your non-profit organization depends on several factors including the size and complexity, potential legal liabilities, how you plan to raise funds, etc. In order to decide on the specific type of entity you should choose to register your non-profit group in Singapore, you should review the details of each type of entity as provided below and then decide on the non-profit entity type that’s most suitable for your situation.
REGISTRATION AS A PUBLIC COMPANY LIMITED BY GUARANTEE
Forming a company limited by guarantee for setting up a non-profit organization has the distinct advantages of incorporating a separate legal entity with limited liability for its members. Out of the various choices available, this form of entity is the most advanced and the most desirable type of structure. Companies limited by guarantee are typically engaged in non-trading charitable, religious, scientific, or artistic activities.
What is a Company Limited by Guarantee?
  1. A public company limited by guarantee is one which carries out non-profit making activities that have some basis of national or public interest, such as for promoting art, charity etc.
  2. The company has no share capital.
  3. A company limited by guarantee has members, rather than shareholders, the members of the company guarantee/undertake to contribute a predetermined sum to the liabilities of the company which becomes due in the event of the company being wound up. The sum set aside as guarantee may be as low as SGD 1.
  4. A Singapore company setup as a public company limited by guarantee must include the suffix “Limited” in its name. However after incorporation, the company may apply to Singapore authorities for the removal of the word “Limited” from its name. One condition of this exclusion is that the company does not distribute profits.
  5. A company limited by guarantee is a legal entity which exists in its own right in the eyes of the law, separate and distinct from the individuals who are involved in it. A company is like a person in law. It can sue, or to be sued, in its own name; it can enter into contracts, and can own property all in its own name.
Benefits and Drawbacks
  • Enjoys an independent legal personality
  • Members’ liability is restricted
  • Subject to ongoing public disclosure obligations and statutory control
  • Professional assistance required for incorporation and ongoing statutory compliance
  • More complex annual reporting requirements that are not always suitable for small groups
Tax exemptions
Associations registered as company limited by guarantee in Singapore are exempt from income tax if surplus funds are from members’ contributions; or if over 50% of gross revenue receipts are from members and are not tax-deductible for members. For full tax exemption, the company must apply for Charity status after its registration.
Key facts at a glance
  1. Requires at least 2 directors, 2 members, and qualified Company Secretary. One director and secretary must be ordinarily resident in Singapore i.e. a Singaporean Citizen, a Singaporean Permanent Resident. A foreigner who wishes to act as a local director of a company has to be a person who has been issued a Employment Pass or a Dependant Pass.
  2. Must draft a Memorandum & Articles of Association setting out the objects and by-laws of the organisation.
  3. Must audit accounts annually.
  4. Must hold Annual General Meetings.
  5. Must file its Annual Returns with ACRA.
Public companies limited by guarantee are registered with Accounting and Corporate Regulatory Authority (ACRA) and are governed by the Singapore Companies Act. You should seek professional assistance if you are interested in registering a Public Company Limited By Guarantee in Singapore.
REGISTRATION AS SOCIETY
A society is defined as a club, company, partnership or association of 10 or more persons, whatever its nature or objective, and not already registered under any other law. Society is suitable for membership or volunteer based groups, especially smaller groups with strong community links and not heavily dependant on donations and external funding.
Benefits and drawbacks
  • Quick, easy and inexpensive to establish
  • Donors prefer more formal business structure arrangements such as public company limited by gaurantee
  • Does not enjoy a separate legal identity status thus members are exposed to liabilty issues
Tax exemptions
Societies registered with the Registrar of Societies (ROS) are exempt from income tax if surplus funds are from members’ contributions; or if over 50% of gross revenue receipts are from members and are not tax-deductible for members. For full tax exemption, the society must apply for Charity status after its registration
Statutory Requirements
  1. A minimum of 10 persons are required to form a society.
  2. Mandatory 3 key office bearers, i.e. President, Secretary and Treasurer who should be Singapore Citizens or Singapore Permanent Residents.
  3. Must audit accounts annually.
  4. Must file Annual Returns with Registrar of Societies
  5. Must draft a Constitution that governs the society
Societies are registered with the Registrar of Societies (ROS) and are governed by the Singapore Societies Act. You should seek professional advise if you are interested in registering a Society in Singapore.
REGISTRATION AS A CHARITABLE TRUST
A trust is an arrangement, set out in a written document (called the trust deed) in which an owner or founder hands over property and/or funds to a group of people (called trustees) who administer the assets for the benefit of other people (called beneficiaries) for a stated objective. A charitable trust is a type of purpose trust in that it promotes a purpose and does not primarily benefit specific individuals.
Who should register a charitable trust?
  • A charitable trust or foundation in Singapore is a legal entity which can be set up by anyone who has decided they want to commit to setting aside some of their assets or income for charitable causes and who wishes to take a structured and ongoing approach to giving.
  • A common use of a charitable trust is for the administration of a scholarship or bursary.
  • It is not usually a useful structure if it will be exposed to a significant risk of liability arising from its operations and transactions e.g when the organization intends to own or lease real estate (such as a sports facility), enter into a number of contractual relationships, etc.
  • It is useful where the trustees are primarily to hold and invest funds or other similar property and to disburse the income from available funds.
Benefits and drawbacks
  • Limited public disclosure – there need not be an auditor or audited financial statements unless these are required by the trust deed
  • Expensive and time consuming to establish and requires professional assistance
  • No independent legal personality
  • Control is with the trustees – there is no accountability to a wider membership base
Statutory Requirements
  1. Must have a board of trustees.
  2. Must have a trust deed – the constitution of the charitable trust, which sets out the framework within which the trustees must operate.
Trusts are licensed by the Monetary Authority of Singapore (MAS) and are governed by the Singapore Trust Companies Act. You should seek professional advise if you are interested in registering a Charitable Trust in Singapore.
APPLYING FOR CHARITY STATUS
After the non-profit entity (society, company limited by guarantee, trust) has been registered and obtained a legal status in Singapore, it is possible to secure charitable status. When reviewing the application for charity status, the Commissioner of Charities will look at whether the objectives of the organisation are acceptable as charitable.
Being a charity is a matter of status, not of organisational structure. Charity status brings certain benefits such as
  1. All registered charities in Singapore enjoy automatic tax exemption.
  2. It gives a standing and credibility to the organisation.
  3. Charitable status is beneficial for fund raising. Many grant-giving trusts and foundations can only give funding to recognised charities. “Charity” is a very emotive word and can be very persuasive in encouraging the general public to donate.
Charitable purposes can be classified into 4 main categories:
  • the relief of poverty
  • the advancement of education
  • the advancement of religion
  • other purposes beneficial to the community with the following purposes explicitly recognised as charitable:
    • the advancement of health;
    • the advancement of citizenship or community development;
    • the advancement of arts, heritage or science;
    • the advancement of environmental protection or improvement;
    • the relief of those in need by reason of youth, age, ill-health, disability, financial hardship or other disadvantages and
    • the advancement of animal welfare.
All charities in Singapore are governed by the Singapore Charities Act and must be registered with the Commissioner of Charities within 3 months of its set-up. Processing time takes about three months. There is no charge for registering a charity under the Charities Act.
Statutory compliance
On acquiring charity status the following compliances must be adhered to. All charities must:
  • submit financial statements and an annual report detailing activities conducted and proposed future plans
  • ensure that accounting and donations records are maintained properly
  • submit annual returns
  • hold AGMs
  • disclose fund-raising information online
Tax exemptions
To grow Singapore as a philanthropy hub, automatic tax exemption is now available for all registered charities.
APPLYING FOR INSTITUTIONS OF A PUBLIC CHARACTER (IPC) STATUS
An approved IPC is an NPO with a charity status whose activities are beneficial to the community in Singapore as a whole, and not confined to sectional interests or group of persons based on race, creed, belief or religion. IPC are approved by the Commissioner of Charities to receive tax-deductible donations (i.e. donors are given tax deduction for donations made to these organisations). Most IPCs are charities, and the rest are sports associations. The processing time on applying for IPC status takes about two months.
Who can apply for IPC status?
  1. a hospital not operated or conducted for profit;
  2. a public or benevolent institution not operated or conducted for profit;
  3. a public authority or society not operated or conducted for profit and which is engaged in research or other work connected with the causes, prevention or cure of disease in human beings, where the gift is for such activities;
  4. a university or a public fund for the establishment, maintenance, enlargement or improvement of a university;
  5. an educational institution not operated or conducted for profit, or a public fund for the establishment, maintenance, enlargement or improvement of such an educational institution;
  6. a public or private fund for the provision, establishment or endowment of a scholarship, exhibition or prize in a university, or an educational institution not operated or conducted for profit;
  7. a public fund established and maintained for the relief of distress among members of the public;
  8. a charitable institution or a body of persons or a trust established for charitable purposes only; or
  9. an organisation not operated or conducted primarily for profit which is engaged in or connected with the promotion of culture or the arts or with the promotion of sports.
Statutory Compliance
On acquiring IPC status, the following compliances must be adhered to. All IPCs must:
  1. issue Tax Deduction Receipts to donors upon receiving tax deductible donations
  2. maintain Donation Records
  3. post financial and non-financial information online
  4. submit audited financial statements
  5. submit an annual return of donations
  6. submit an annual report detailing the use of donation money and proposed future plans
  7. be administered by a group of independent trustees i.e. there must be independent control
Tax deductible donations
Only donations to a charity that is an approved Institution of a Public Character are tax deductible (i.e. donors are given tax deduction for donations made to these organisations). Not all registered charities are approved IPCs. Donations made to a charity without approved IPC status is NOT income tax-deductible.
The following types of donations normally qualify you for a tax deduction:
  • Cash Donations
  • Shares Donations
  • Computer Donations
  • Artefact Donations
  • Public Art Tax Incentive Scheme
  • Land and Building Donations
If the donations or gifts are for a “foreign charitable purpose”, they are not tax deductible even though they are made to an approved Institution of a Public Character (IPC).
PROFESSIONAL HELP
If you are interested in setting up a non-profit entity in Singapore, you should seek the services of a professional services firm that can assist you with the registration as well as on-going statutory compliance matters of the entity.
POST REGISTRATION – PART 2
Once you have registered your NPO in Singapore, the challenge ahead is fundraising, publicity and volunteers – the key determinants to the successful running of your NPO. To find out more about these facets, refer to Setting up a non-profit entity in Singapore – Part 2.

WARNING: How trustworthy is an organization/shelter/group that collects funds but dont file Income Tax or a license.

Many of you may think that collecting funds from the public to help the needy is somewhat a justification to the cause without a license.

How could you trust or support anyone who does this behind by showing the effort they put in by helping the animals, some even help many. And they say"Oh all the money I collect goes to the animals." but hey if all the money goes to the animals than how could you not be able to do it the right and legal way unless you have some thing to hide and am too afraid of Income Tax looking over your shoulders. Better still with CIPB come knocking at your door, I never trust a person like this, if any of you got the cheek to you say you do, than feel free to give me your atm card and money as it is for the cause of animals too.The words a person could put up to be manupulative and sly to get the public to donate without the public knowing that they have the license to do so is consider false fund raising and a person with an expectations. I would say maybe not all the money goes to the animals, a 50-50, 60-40, 30-70.

And if anyone who wants to challenge that kindly do remember if you dare challenge, it also means you have previously help or is still helping someone do fund raising without a license, fund raise without a license is definitely a serious offence. I never trust such a person, not even if it is in times of war. A person who is willing to help animals without any benefit will abide to the rules pertaining to the law and no matter how they sweet talk, tell that to the judge before you come and say a word to me.Just be warned if you donate with a cause, make sure the cause comes with a license as when there is a license, every single cent that is collected is calculated and not a cent goes missing. BE SMART AND CHECK. CALL THE AUTHORITIES IF YOU ARE NOT SURE TO VERIFY. PREVENTION IS BETTER THAN CURE.

**Please note if I or any of my friends who come across a fund raising event that is being done, we will not hesitate to take photos and inquire to the relevant authorities. I will not waste time entertaining such arrogant-self-centered-manupulative-money-grabbing-animal-make-user-cheat.
People make use of everyone or anything, no matter what the cause might be, its a simple common sense will put a person figuring out whether what was written has been stated to be the facts.

Ok this will be up here for all to read and be warned, kindly check and please be inquisitive as you might end up knowing the truth amongst the hidden agenda.

POSTING OF WEBSITES FROM OTHER GROUPS

All members are to take note, that we would not allow postings from other website groups without approval from any of the admins. If you require to post here, please submit the following to PLFA:

  • Photocopy of NRIC / EZ-link / Passport
  • Home and cellphone contact numbers
  • Registered Shelter Address
  • Agreement Letter from Pets Looking For Adoption
Please note that all the above documents should be emailed to Ms.Belinda for verification / authentication before you are permitted to post in the group.

No adoption fee shall be above S$200.00 (Two hundred Dollars Singapore)
Any adoption fee above the stated amount, kindly produce the original receipts which is not more than 2 weeks backdated.

All members are advise to inform PLFA if there are any rehomers/ rescuers / shelters / person (s) charging above the stated amount and does not have any receipts to verify such claims. We will blacklist the person.

Also note that it is common sense, if someone wants the pet to be adopted than there should be no charges at all unless if there are some recent bills that have been applied to the animal. It is also up to the adopter to have the courtesy to either give a small token of appreciation to any helpers who also have other animals they are looking after or for the medical expenses that were incurred.

We will not entertain any remarks / rude comments of rehomers/ rescuers / shelters / person (s) as they are not from PLFA and PLFA does not commit to their demands. It is solely up to the discretion of the adopter who deem fit whether the charges are reasonable for the pet to be adopted. Just remember, the meaning of adoption does not come with a single cent being exchange if there is sincerity and honesty between both parties.Those who make post with regards to other websites no matter what their cause is without getting approval from admins will have it removed immediately by the admins without any given reason.

"Pets Looking For Adoption Rules Shall Never Be Broken, if its broke, We Don't Need You."

Adoption Fees

Please note if an animal is up for adoption in Pets Looking For Adoption and the fee is above S$200, please upload the images of the receipts for sterilization / d-wormed / medical bills / micro-chipped together with the photo of the animal.We have countless of emails from members telling us that what has been advertise and what has been said over the phone conversations were not similar pertaining to the posts. There have been ridiculous prices being offered and its more like having the pet put on sale rather than it getting adopted which in turn give adopters second thoughts of owning the animal. There are some who have been known to be rather aggressive when they put the pet up for adoption. Anyone who has encountered such cases please do not hesitate to inform us and we would gladly investigate and if we do find that the rehomers / shelters / rescuers are rude and not willing to reveal anything further, we would list out these and warn all adopters to be careful when adopting a pet from them.

Different groups work differently in all and any issues, but to profit from such things, the party has to have supporting documents to verify such claims before putting the animals up for adoption.

PLFA will not entertain anyone without any documents to state the claims for adoption fees.
PLFA has the right to terminate the member from the group if the rules are broken.
PLFA will not allow anyone to amend their rules to the other party's agenda or purpose.
PLFA will not hesitate to blacklist anyone who states ridiculous fees.

If you expect to put up such prices here without proper documentations, we would suggest you look for another site to make your post as we feel that you are not deem fitted to contribute to the adoption for the animals and we will not entertain to reply any comments from any said party's as the posts will be deleted and the said party be banned without any reasons.

No Legal action can be taken against PLFA for the rules stated. PLFA has every right to protect any member.

REHOMING AGREEMENT FOR DOGS

Rehoming Agreement
                                    in ensuring the welfare and health of the dog.

I, ____________________________________ ( Name), of NRIC no: ____________________
hereby undertake the full responsibility to commit to my dog, _____________________________ (Name) for the rest of his or her life.

I understand the vital need to ensure the welfare and health of my dog in the areas of:
·         Anti-chaining and penning: My dog will not be perpetually chained up or kept in any forms of confinement that restrict his or her natural patterns of behaviour, expression and movements.

·         Abuse and neglect: No form of abuse or neglect will be inflicted on my dog, either by acts of commission or omission.

·         Good diet: A suitable diet will be fed to maintain the good health of my dog. A healthy diet will ensure good health for the lifespan of my dog, with lower medical issues and thus, lower medical bills to handle.

Can food is NOT advisable. Dry kibbles or dehydrated foods of a premium standard can be fed as part of a homecooked meal. Some recommended brands are Natural Balance, Addiction, Azmira, Timberwolf Organics, Back To Basics, California Natural
.

Homecooked meals of boiled meats (lamb, chicken, pork, beef, fish), vegetables (carrots, broccoli) and carbohydrates (brown rice, potatoes) can be fed. Dogs are primarily meat-eaters, thus the portion of meat protein must be significantly higher than the carbohydrates. Strictly NO fish, chicken, duck bones to be given. Pork, lamb, beef bones may be given under supervision.

·         Lifelong commitment: Should I move to a new residence or country, I will take my dog along with me; my dog is integral to my lifestyle no matter where we live. In the extremely unfortunate event where my dog is not able to live with me, I will seek all possible ways to remedy the situation and seek help from welfare societies and rehomers to secure a good new home for my dog. If in any way if I abandon my pet to SPCA / Foster Homers / Volunteers, legal action will be taken against me for the well being of my pet for the rest of it’s life. All legal cost on both parties will be paid by me  and a letter of apology will be publish in the local newspaper for abandoning the pet.

I also agree to the following:
1.    Allow home visits by rehoming personnel to help with any issues associated with new adoptions and assist in adaptability of both adopter and adoptee. Stipulated timelines are within 2 week, 1 months, 6 months and 1 year from the day of adoption.
2.    Adoptee must be vaccinated, microchipped and licensed at the adopter’s expense.
3.    Adoptee must be sterilised at the adopter’s expense, if not done so already. Sterilisation must be done when adoptee is at least 6 months old, regardless of gender.
4.    Adopter must contact and be willing to work with rehoming personnel on any issues associated with the adoption.
5.    Adopter must inform rehoming personnel of any change in address, ownership or any event that may cause distress to the physical and mental well-being of the adoptee. Adopters who intend to leave Singapore permanently must bring adoptee along with them or secure a good new home for the adoptee. At no time should the adopter attempt to absolve his/her responsibility by abandoning the adoptee.
6.    Rehoming personnel reserves the right to obtain possession of the adoptee should there be signs of abuse and neglect, e.g., malnutrition, unnecessary beatings, ill treatment, constant chaining/caging, and other mistreatment that restricts the adoptee’s natural pattern of behaviour, expression and movement.

I have read and understood the above, and I undertake to take good care of the adoptee to the best of my ability.
